Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of the website at luminamg.com and any services we provide (the "Services"). Lumina MG is operated by Sam Yan.

By accessing or using our website or Services, you agree to be bound by these Terms. If you are using the Services on behalf of a business or other entity, you represent that you have the authority to bind that entity to these Terms.

Message types

Depending on the categories you consented to, you may receive appointment confirmations, reminders, scheduling updates, meeting links, customer support messages, and general information about our Services. You will only receive marketing or promotional messages if you have separately provided marketing consent.

Consent

SMS consent is optional and is not required to purchase a service or book an appointment. You will only receive messages in the categories you expressly consented to.

Message frequency and charges

Message frequency varies. Message and data rates may apply. Contact your wireless provider for questions about your messaging plan.

Opt-out instructions

You can opt out at any time by replying STOP to any message from us. We will send a confirmation, after which you will no longer receive SMS from that program. You can rejoin by opting in again.

Carrier disclaimer

Wireless carriers are not liable for delayed or undelivered messages.

Age requirement

You must be 18 years or older, or have parent or guardian permission, to enroll in our SMS program.

Fees, payment terms, and refund terms for any engagement are set out in the applicable engagement agreement. Unless the engagement agreement states otherwise, fees are non-refundable. You are responsible for any applicable taxes.

Lumina MG retains all rights, title, and interest in its website, brand, software, templates, tools, methodologies, and other pre-existing or independently developed materials. You retain rights to the content and materials you provide to us. Unless your engagement agreement says otherwise, deliverables produced for you are licensed to you upon full payment.

Our Services may rely on or interoperate with third-party platforms, tools, or providers. Your use of those third-party services is subject to their own terms and policies. Lumina MG is not responsible for the availability, actions, or omissions of third parties.

9. Disclaimers

The site and Services are provided on an "as is" and "as available" basis. We do not guarantee any specific business outcomes, including leads, conversions, revenue, rankings, or other results.

10. Limitation of liability

To the fullest extent permitted by law, Lumina MG and Sam Yan will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the site or Services. Our total liability for any claim arising out of or relating to the site or Services will not exceed the amount of fees you paid to Lumina MG in the 12 months preceding the event giving rise to the claim.

You agree to indemnify and hold Lumina MG and Sam Yan harmless from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the site or Services, the content or information you provide to us, or your violation of these Terms or applicable law.

We may suspend or terminate your access to the site or Services if you breach these Terms or if we reasonably determine that continued access presents a security, legal, or operational risk. Termination of an engagement is governed by the applicable engagement agreement. Provisions of these Terms that by their nature should survive termination will continue to apply.

13. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Services will be resolved exclusively in the state or federal courts located in California.

14. Changes to the terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of the page. Your continued use of the site or Services after changes take effect constitutes acceptance of the updated Terms.
